Updated Privacy Policing Pertaining to General Data Protection Regulation (GDPR)

There are certain instances when FluxData Incorporated may collect and process certain personal information about you. At FluxData we are committed to protecting your personal information and are regulated under applicable data protection laws (including the General Data Protection Regulation, effective as of May 25, 2018). In having your personal information, we are responsible for the purpose of those laws.

The personal information we collect and use

When interacting with our customers, suppliers, competitors, etc., we may collect and process the following personal information you may provide, including your name, job title, employer, business email address and contact details. We may also obtain and process your personal information (your name, job title, employer, business email address and contact details) when you provide it to us for, or at, an external event, or when you provide it to an event organizer and we have sponsored that event.

How we use your personal information

FluxData might use your personal information to:

  • Communicate marketing releases about our latest news, product offerings, services and/or events
  • Communicate with you in response to your inquiries, requests, comments or suggestions
  • Provide you with information, products, or services that you request from us
  • Comply with legal obligations and where necessary for the establishment, exercise or defense of legal claims

Before obtaining or using your personal information, FluxData will always:

  • Obtain your consent
  • Use the information to enable preforming tasks specified in the contract in which you have entered into with us, or in taking steps at your request to enter into such contract
  • Use the information to comply with a legal obligation to which we are subject

FluxData may also use your personal information if it is in ours, or the third parties’ best interest. Our legitimate interests include, providing you with news and information about events, products and services that we believe may be of interest to you or your business, providing you with responses and information you have requested from us and establishing, exercising and/or defending legal claims.

Who your personal information is shared with

FluxData may share your personal information with third parties, including third-party service providers, other entities within FluxData, and our authorized sales representatives and distributors. The information will only be shared with the given third parties if it is essential in following through with a given contract we are in agreement to, or if it will help to provide you with the most up-to-date company content. We may also share your personal information with law enforcement or other authorities if required by applicable law.

All third-party service providers and other entities within FluxData are required to take appropriate security measures to protect your personal information. We do not allow our third-party service providers to use your personal information for their own purposes. We only permit them to access your personal information for specified purposes and in accordance with our written instructions.

How long personal information is kept

We will only retain personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal requirements. To determine the appropriate retention period for your personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purpose for which we process your personal information, whether we can achieve the purpose through other means, and the applicable legal requirements. When it is no longer necessary to retain your personal information, we will securely destroy it in accordance with applicable laws. In addition, personal information can be removed from our database at any time upon request (see “Your rights” below).

Keeping your personal information secure

We have appropriate security measures in place to prevent personal information from being lost, stolen, or misused. We limit access to your personal information to those who have a genuine need to know it. Those third parties we use to process your information will do so only in an authorized manner and will be subject to a duty of confidentiality. If we shall ever suspect a data security breach, we will follow all legal obligations with respect to notifying persons that are involved.

Your rights

Under certain conditions, you have the right to request from FluxData, among other things:

  • Information concerning your personal information and how we are processing it
  • Correction of errors in your personal information
  • Deletion of inaccurate personal information
  • For us to stop certain processing of your personal information, including direct marketing

Shall we have your consent to process personal information (see “How we use your personal information” above), you may revoke your consent at any time. Consequence of not providing your personal information

For customers and prospective customers of FluxData Inc., your personal information may be a requirement necessary to entering into a contract with us. Not providing your personal information could result in not being able to enter into a contract with FluxData, as well as opting out of communication updates regarding FluxData’s latest products and services.
